Overview

These Terms explain how our Pay Monthly Website Plans work. They cover your contract term, payments, what’s included, and how ownership transfers after completing a full 36-month cycle.

What’s Included

• A professionally designed website according to your plan limits
• Hosting on our managed servers (while the plan remains active)
• A free .uk domain (e.g. .co.uk, .uk) for as long as the plan remains active
• Basic technical setup and support
• Access to optional add-ons (extra cost)

If you want a domain with another extension (such as .com or .org), you may use one, but the additional cost is your responsibility.

Pricing & VAT

Unless explicitly stated otherwise, prices displayed on our website are exclusive of VAT. Where VAT applies, it will be added to invoices or checkout totals (if applicable) in accordance with UK rules.

Setup Fee

Each plan has a one-time setup fee that covers the design and initial build of your website.

Contract Term & Renewal

Initial 36-month cycle

• Your monthly price stays fixed during the entire 36 months (unless agreed in writing).
• After completing 36 consecutive payments, you become eligible for a full refund of the setup fee if you cancel at the end of the cycle.

Automatic renewal

At the end of the 36-month term, the plan automatically renews for another 36 months unless you instruct us to cancel before renewal.

Renewed cycles

• No additional renewal fees apply.
• During renewed cycles, your monthly plan price may increase by up to 2% every April. We will notify you before any change takes effect.
• Setup fee refunds apply only when a full 36-month cycle has been completed and you cancel at the end of that cycle.

Billing & Suspension

Your monthly plan fee is collected automatically using the payment method you provide.

Missed or overdue payments may result in temporary suspension of your website and related services until the account is brought up to date.

Cancellation

You may request cancellation at any time via our contact form.

Cancel before 36 months

• The setup fee is not refunded
• Your website may be removed from hosting
• Early termination or cancellation fees may apply

Cancel after 36 months

• You may request a full refund of the setup fee
• You may request transfer of your domain and website files
• .uk domains are transferred for free (subject to account being fully paid)

Domain Terms

• A free .uk domain is included in all Pay Monthly Plans.
• The domain remains under our management while the plan is active.
• After 36 months and cancellation, the .uk domain can be transferred to you at no cost.
• For early cancellations, transfer may require an admin fee and may not be available if payments are overdue.

Website Ownership

Before completing 36 consecutive monthly payments, the website design, structure, and build remain the property of Empex Digital.

After completing 36 months and cancelling, ownership is transferred to you. Proprietary tools, internal frameworks, and reusable components remain Empex property.

Upgrades

You may upgrade your plan at any time.

• A new setup fee for the upgraded plan must be paid
• Your monthly cost increases according to the new plan
• The upgrade starts a new 36-month contract cycle
• Previous setup fees are carried forward and may be refunded only after completing the new cycle (if you cancel at the end of that cycle)

If you cancel the upgraded plan before completing its 36 months, no setup fees (old or new) are refunded.

Responsibilities

Your responsibilities

• Provide accurate business information, images, and content needed to build your website
• Ensure legal compliance of all content (GDPR, cookies, policies)
• Respond to design drafts and requests in a reasonable time
• Keep payment details active and up-to-date

Our responsibilities

• Build your website according to the selected plan
• Host and keep the website online while the plan is active (subject to billing and acceptable use)
• Maintain core systems and apply essential updates to managed infrastructure
• Provide communication for billing, renewals, and plan-related updates

Add-ons & Paid Advertising

Optional add-ons (extra cost) include maintenance, additional pages, increased media storage, booking systems, blogs, payment gateways, and other enhancements. Add-on pricing may change over time.

Google Ads / paid advertising: Google Ads campaign setup, management, optimisation, and reporting are not included in Pay Monthly plans, Maintenance, or SEO packages unless explicitly agreed in writing. Paid advertising can be added as an add-on service if requested.

SEO & No Guarantees

We follow best practices and can make measurable improvements. However, we do not guarantee that your website will achieve specific rankings or positions on Google (or other search engines). Search performance depends on factors beyond our control, including competition, algorithm updates, content quality, backlinks, and domain authority.

Where SEO work and monitoring are included as part of your plan or a dedicated Maintenance Plan, we can implement improvements and monitor progress over time. The level of ongoing monitoring and optimisation depends on the plan you choose.

Acceptable Use

Websites must not contain illegal, harmful, infringing, or abusive content. We may suspend or remove websites that violate these rules.

Limitation of Liability

Empex Digital is not liable for loss of profits, business interruption, data loss, or issues caused by third-party providers. Our maximum liability is limited to the amount you paid in the 12 months before a claim.
